The impeachment of the President of India is a constitutional process in which the President can be removed from office for "violation of the Constitution." The Constitution of India provides for the impeachment of the President on the grounds of "violation of the Constitution, gross misbehavior, or incapacity."
The impeachment process is outlined in Article 61 of the Constitution of India. The process begins with a notice of motion signed by at least one-fourth of the total number of members of either the Lok Sabha (the lower house of the Parliament of India) or the Rajya Sabha (the upper house of the Parliament of India). The notice of motion must specify the charges against the President.
The notice of motion is then referred to a three-member committee, consisting of the Chief Justice of India, a Supreme Court judge, and the Speaker of the Lok Sabha (or his nominee). The committee investigates the charges and submits a report to the Parliament.
If the committee finds the charges to be justified, a resolution for the impeachment of the President is introduced in either the Lok Sabha or the Rajya Sabha. The resolution must be passed by a two-thirds majority of the total membership of the house in which it is introduced. If the resolution is passed, it is then presented to the other house for consideration.
If the resolution is passed by a two-thirds majority in both houses, the President is impeached and removed from office. The Vice President of India succeeds the President in the event of impeachment.
To date, no President of India has been impeached. However, there have been instances where the threat of impeachment has been used as a political tool, such as in the case of President Fakhruddin Ali Ahmed in the 1970s.
